COSTOS ECONÓMICOS Y NO ECONÓMICOS PARA LAS EMPRESAS, VÍCTIMAS Y VICTIMARIOS DE CONDUCTAS CONSTITUTIVAS DE ACOSO LABORAL ASOCIADAS AL BIENESTAR LABORAL EN COLOMBIA

La ley de acoso laboral en Colombia identificada como ley 1010 de
2006, no solo entró a regular los actos hostiles que al interior de
las relaciones laborales subordinadas se pueden presentar, sino que
además de tipificar dichas conductas, impuso a los empleadores la
responsabilidad en la prevención y en la reparación del daño generado
por los actos negativos constitutivos de acoso laboral, al establecer una
serie de circunstancias que llevan a que las empresas, en razón de la teoría del riesgo profesional, puedan verse involucrados a responder
por acción u omisión sobre los daños que puedan producir sus
trabajadores sobre las posibles víctimas. Frente a esto las empresas
deben asumir los costos de la generación de conductas de acoso
laboral. En consecuencia, la ley 1010 de 2006, dentro de las acciones
preventivas, impuso una obligación a la empresa, consistente en hacer
seguimiento a conductas hostiles, a través de la conformación del
comité de convivencia laboral, organismo plural y bipartito, donde
existe participación de representante de empleadores y trabajadores,
con el fin de servir de mediadores o conciliadores frente a hechos que
puedan ocasionar acoso laboral. Así las cosas se observa que frente
al tema del acoso laboral y a la forma en que la ley quiso involucrar
a los empleadores, estos tienen una responsabilidad que nace de la
teoría del riesgo profesional, esto es, que las empresas o empleadores,
por ser quienes generan el riesgo con la contratación de personas
bajo subordinación laboral, son llamados a responder por los daños
que se le ocasionen a quienes sean víctimas de acoso laboral y de
igual forma, deben responder por los actos que otros trabajadores,
en calidad de victimarios, ocasionen, precisamente por el carácter
subordinante de las relaciones de trabajo. The law on harassment at work in Colombia, identified as Law
1010 of 2006, not only regulates hostile acts that may occur within
subordinate labor relations, but also typifies such conduct, imposing
on employers the responsibility to prevent and repair the damage
generated by negative acts constituting harassment at work, by
establishing a series of circumstances that lead companies, on the
theory of occupational risk, to be involved in responding by action or
omission on the damage that their workers may produce on potential
victims. Faced with this, companies must assume the costs of
generating conduct of harassment at work. Consequently, Law 1010
of 2006, within the preventive actions, imposed an obligation on
the company, consisting of following up on hostile conduct, through
the formation of the committee for labor coexistence, a plural and
bipartite body, where there is participation by representatives of
employers and workers, in order to serve as mediators or conciliators in the face of events that may cause labor harassment. Thus, it can
be seen that in the face of the issue of harassment at work and the
way in which the law wanted to involve the employers, these have
a responsibility that is born of the theory of professional risk, that
is, that the companies or employers, because they are the ones who
generate the risk with the hiring of people under labor subordination,
are called to respond for the damages that are caused to those who
are victims of harassment at work and in the same way, they must
respond for the acts that other workers, as victimizers, cause, precisely
because of the subordinate character of the labor relations.
