Para esto, se revisan diversas fuentes legales, jurisprudenciales y doctrinales en las que se enmarquen el fenómeno de habitabilidad en calle, en qué medida este es un aspecto vulnerador de los derechos fundamentales del menor en virtud del principio de prevalencia de sus intereses, el concepto de lo que se entiende por “niño”, y, especialmente, la exigencia en cuanto a la protección de los bienes jurídicos de los niños en el contexto de la migración y la especial necesidad de protección. Asimismo, se describe un panorama social de la condición de habitabilidad en calle de los niños migrantes venezolanos, asentados en zonas específicas de la ciudad de Santa Marta, para determinar qué derechos y principios están siendo vulnerados o se encuentran en riesgo.In this research, it is proposed to analyze the scope of the violation of the fundamental rights of Venezuelan migrant children, in a condition of habitability on the street, in the city of Santa Marta, since 2018. For this, various legal sources are reviewed, jurisprudential and doctrinal in which the phenomenon of street habitability is framed, to what extent this is an aspect that violates the fundamental rights of the minor by virtue of the principle of prevalence of their interests, the concept of what is understood by “child”, and, especially, the requirement regarding the protection of the legal rights of children in the context of migration and the special need for protection. Likewise, a social panorama of the living conditions on the streets of Venezuelan migrant children, settled in specific areas of the city of Santa Marta, is described to determine which rights and principles are being violated or are at risk.
