En esta medida ha sido la ley quien ha determinado cuando hay lugar a hacer uso de esta figura, como también los efectos que esta genera, es decir, si la respuesta se entiende como negativa o positiva. De acuerdo con lo anterior, en este trabajo se tuvo como objetivo general Establecer el desarrollo histórico normativo del silencio administrativo en el derecho administrativo colombiano. En cuanto a la metodología se trata de una investigación jurídica desarrollada desde una perspectiva cualitativa y un análisis hermenéutico. Al final se determinó que el silencio administrativo se reglamentó en el país desde el año 1984, y posteriormente se han expedido normas que han integrado aspectos relativos a este, encontrándose su regulación actual en la Ley 1437 de 2011, sin embargo, se puede afirmar que no ha tenido un desarrollo legislativo amplio. To this extent, it has been the law who has determined when it is necessary to make use of this figure, as well as the effects that this generates, that is to say, if the answer is understood as negative or positive. In accordance with the above, the general objective of this work was to establish the historical normative development of the administrative silence in the Colombian administrative law. As for the methodology, it is a legal research developed from a qualitative perspective and a hermeneutic analysis. In the end it was determined that administrative silence was regulated in the country since 1984, and subsequently rules have been issued that have integrated aspects related to this, finding its current regulation in Law 1437 of 2011, however, it can be stated that it has not had a comprehensive legislative development.
