Ello por medio de un estudio documental y del análisis de contenido de textos jurídicos, así como académicos, internacionales y nacionales que ayudaron a describir el garantismo que realizan los jueces para proteger los Derechos Humanos en México. El principal hallazgo apunta al actuar de los jueces penales sobre el deficiente garantismo jurídico hacia los Derechos Humanos en general, puesto que no realizan un control difuso de estos ya sea por desconocimiento en cómo aplicarlo, porque se ven involucrados en intereses económicos y aspectos sociales, como la presión social en la toma de sus decisiones, o simplemente por cuestiones políticas.The objective of this work is to analyze the actions of the judges in the criminal process in compliance with human rights from the 2011 reform through a documentary investigation using the content analysis of national and international legal instruments, as well as of different types of academic texts that helped describe the guarantees that judges make towards the protection of human rights in Mexico.
