Dada la imposibilidad de representación legal para el ejercicio de estos derechos de carácter personalísimo, las soluciones deben brindarse en pos del reconocimiento de la capacidad progresiva y de acuerdo con el grado de desarrollo y la madurez individual alcanzados por los jóvenes. Se desarrolló, a través de una investigación cualitativa y descriptiva, un análisis sobre la capacidad de obrar y la capacidad progresiva de los adolescentes, frente a los derechos sexuales y reproductivos en la adolescencia y reflexiones en torno a estos derechos con enfoque de género, logrando concluir que, en los derechos sexuales y reproductivos, por su marcado carácter personalísimo, no existe cabida para ninguna de las formas de representación y deben ejercitarlos los individuos por sí mismos, el disfrute de la sexualidad por los adolescentes, con independencia de su género, no siempre se corresponde con el arribo a la mayoría de edad y carece de vínculos con la plena capacidad de obrar. El reconocimiento a la capacidad progresiva de los adolescentes y el ejercicio de sus derechos reproductivos y sexuales ha de seguir potenciándose para lograr la igualdad de todos ante la ley.The sexual and reproductive rights of adolescents need legislative solutions that allow them to exercise them per se.
