La ausencia o violación de este derecho acarrea como consecuencia la vulnerabilidad absoluta de una persona en cualquier lugar del mundo. Debido a la crisis política, social y económica que ha enfrentado Venezuela, se ha producido la mayor migración observada hacia Colombia en la historia. Gran cantidad de venezolanos entran diariamente al país en búsqueda de una mejor calidad de vida; el Estado Colombiano, en su posición de garante, se ve en la obligación de generar políticas de Gobierno orientadas a la satisfacción de los Derechos Humanos Fundamentales de los migrantes, y, en particular, los de los niños, puesto que ellos representan el interés superior de cualquier Gobierno.
