Además de haberse contemplado la naturaleza de las obligaciones frente a las que procede el proceso monitorio, se estableció como uno de sus requisitos ineludibles el deber de notificación personal del demando. La problemática frente a esta exigencia se centra en que ello afecta el derecho a la tutela judicial efectiva del demandado porque la falta de la misma impide continuar con el trámite del proceso, por lo que en este trabajo se tuvo como objetivo general analizar si afecta el derecho a la tutela judicial efectiva del demandante la exigencia de notificación personal en el proceso monitorio. Metodológicamente se acudió a una investigación de revisión teórica, con uso del enfoque cualitativo y del método hermenéutico jurídico. Se concluye que, si bien es cierto, que la falta de notificación personal impide continuar con el trámite, también es cierto, que el demando cuenta con otros medios para lograr la protección de su acreencia, aun cuando tarde más tiempo que si hiciere uso del proceso monitorio. El trabajo.The payment order process is one of the most important tools currently in the Colombian procedural legal system, due to the understanding of the social reality that was had at the time of implementing this process, since it seeks to protect the informal contractual relations where the creditor lacks a true executive title, allowing it to be constituted and later executed. In addition to having considered the nature of the obligations against which the order for payment process proceeds, one of its unavoidable requirements was established as the duty of personal notification of the defendant. The problem with this requirement focuses on the fact that it affects the defendant's right to effective judicial protection because the lack of it prevents the continuation of the proceedings. Therefore, the general objective of this paper was to analyze whether the requirement of personal service in the order for payment procedure affects the plaintiff's right to effective judicial protection. Methodologically, an investigation of theoretical review was used, with the use of the qualitative approach and the legal hermeneutic method. It was concluded that, although it is true that the lack of personal notification prevents the continuation of the procedure, it is also true that the plaintiff has other means to achieve the protection of his claim, even if it takes longer than if he had made use of the order for payment procedure.
