Se conceptualizó desde la doctrina y la jurisprudencia la importancia del debido proceso y el principio de publicidad en la imposición de una foto multa. También se analizó la responsabilidad solidaria del Estado Colombiano por la debida notificación de las infracciones de tránsito en Colombia, así como el marco legal y normativo por medio del cual la jurisprudencia constitucional ha diferenciado entre las garantías previas y posteriores que implica el derecho al debido proceso en materia administrativa. Adicionalmente, fue analizado todo tipo de regulación que da lugar a sanciones y restricciones por la comisión de infracciones de las normas de tránsito, así como en el otorgamiento de las facultades y competencias necesarias a las autoridades de tránsito para imponer o aplicar dichas sanciones a los infractores. Finalmente, se realizó una encuesta dirigida a todas aquellas personas que durante los años 2016 a 2018 se les vulnero el derecho al debido proceso en virtud a la indebida notificación de una infracción de tránsito. Todo lo anterior, con el fin de responder la pregunta problema: ¿Cómo se da la protección del derecho al debido proceso frente al principio de publicidad en materia de infracciones de tránsito en Magangué- Bolívar entre los años 2016-2018?, ante lo cual se ha logrado analizar que se evidencia la vulneración que existe por parte de las autoridades de tránsito en cuanto al principio de publicidad en relación con el derecho al debido proceso en procedimientos por infracciones diversas, entre ellas las iniciadas por imposición de foto multas. El trabajo.With the development of the present investigation, the constitutional duty of the Colombian State was analyzed at the time of exercising control and vigilance in the possible infractions for noncompliance with traffic regulations. Doctrine and jurisprudence conceptualized the importance of due process and the principle of publicity in the imposition of a fine photo. It also analyzed the joint and several liability of the Colombian State for the due notification of traffic infractions in Colombia, as well as the legal and normative framework through which constitutional jurisprudence has differentiated between prior and subsequent guarantees implied by the right to due process in administrative matters. In addition, all types of regulations that give rise to sanctions and restrictions for the commission of infractions of traffic rules were analyzed, as well as the granting of the necessary powers and competences to the traffic authorities to impose or apply such sanctions to violators. Finally, a survey was conducted aimed at all those persons whose right to due process was violated during the years 2016 to 2018 as a result of improper notification of a traffic violation. All of the above, in order to answer the problem question: How is the protection of the right to due process against the principle of publicity in the matter of traffic infractions in Magangué-Bolívar between the years 2016-2018? In view of which it has been possible to analyze the evidence of the violation that exists on the part of the transit authorities regarding the principle of publicity in relation to the right to due process in procedures for diverse infractions, among them those initiated by the imposition of photo fines.
