La finalidad de esta investigación fue analizar el cumplimiento del estándar de debida diligencia emitido por las altas cortes colombianas, Corte Constitucional Colombiana, el Consejo de Estado y la Corte Suprema de Justicia frente al delito de violencia sexual ejercido contra mujeres, pertenecientes al Municipio de María la Baja Bolívar, en el marco del conflicto armado. Así mismo, observar el respeto y la garantía de los Derechos Humanos que brindan el estado como garante de Derechos Humanos.The text presented contains a small comparison between the guidelines established by the Colombian courts in relation to the standard of due diligence dealing with the circumstances of fact and law for victims of sexual violence belonging to the municipality of María la Baja Bolivar. The purpose of this research is to analyze compliance with the due dil-igence standard issued by the high Colombian courts, Colombian Con-stitution, the Council of State and the Supreme Court to the crime of sexual violence exercised against women, belonging to the municipality of Maria low Bolivar, in the context of armed conflict.
