SISTEMA DE ADOPCIÓN COMO MEDIDA DE RESTABLECIMIENTO DE DERECHOS DE LA POBLACIÓN INFANTIL EN COLOMBIA

Abstract

Esta investigación trata sobre el proceso de adopción como medida de restablecimiento de derechos en Colombia, se expusieron resultados frente a la pregunta problema de cuáles cambios fueron introducidos por la ley 1878 de 2018 en el proceso de adopción y restablecimiento de derechos del centro zonal de Cereté. Para cumplir los objetivos, se utilizó la metodología cualitativa, que arrojó como resultados que la ley 1878 introdujo cambios favorables en el proceso de adopción en general, en favor de más de once mil (11.000) menores en espera de ser adoptados a enero de 2017, contando con mecanismos de protección constitucional e instrumentos internacionales para su vigilancia, acorde con el enfoque prioritario para la protección de la población infantil también en la legislación interna, presentando la adopción como la me-dida más efectiva para el restablecimiento de derechos y que con los cambios introducidos se logra mayor celeridad y garantías llevando el proceso a buen término, disminuyendo los riesgos y las posibles fallas que pudieran presentarse. El trabajo inicia con el planteamiento del problema y su respectiva justificación, se expone el componente doctrinal de la adopción y las medidas de restablecimiento de derechos, haciendo posteriormente un análisis de la normatividad nacional e internacional respecto a la adopción.

This investigation is about the adoption process as a Colombian rights restoration measure. Results were presented in front of the question problem of what changes were introduced 1878 of 2018 law in the adoption and restoration of rights process of the Cereté zonal center. To meet the objectives, the qualitative methodology will be considered, which resulted in the 1878 law introduced favorable changes in the adoption process in general, in favor of more than one thousand (11,000) minors waiting to be adopted by January 2017, with constitutional protection mechanisms and international instruments for its surveillance, in accordance with the priority approach for the child population protection also in domestic legislation, presenting the adoption as the most effective measure for the rights restoration and with this changes introduced are achieved faster and guarantees the process to fruition, reducing risks and possible failures that occur. The work begins with the approach of the problem and its respective justification, the doctrinal component of the adoption and the rights restoration measures are exposed, later making an analysis of the national and international regulations regarding the adoption.
