ANÁLISIS EN JUSTICIA TRANSICIONAL “Un razonamiento actual ineludible”

Abstract

El propósito de la investigación fue describir la argumentación o análisis de la Justicia Transicional, en un momento coyuntural de Colombia, cuando se logra un acuerdo de paz entre el gobierno y movimientos insurgentes que han trastocado por más de 50 años la tranquilidad, la vida, los bienes de sus habitantes. El estudio estuvo sustentado en los criterios y reflexiones de expertos del Centro Internacional para la Justicia transicional (ICTJ, 2016), las opiniones de Criollo (2016), Ordóñez (2016), Valencia (2011), entre otros. Con tales fines, en su desarrollo se implementó un marco metodológico encuadrado en el paradigma epistémico cualitativo, que apuntó a una investigación documental, analítica, concluyéndose en la existencia de defensores y detractores de las fórmulas de arreglo, conversaciones y acuerdos de paz suscitados, lo que deja en evidencia dificultades complejas de subsanar.

The purpose of the research was the argumentation or analysis of transitional justice, at a moment in Colombia, when a peace agreement is reached between the government and insurgent movements that have disrupted for more than 50 years the tranquility, life, and property of its inhabitants. The study was based on the criteria and reflections of experts from the International Center for Transitional Justice (ICTJ, 2016), the opinions of Criollo (2016), Ordóñez (2016), Valencia (2011), among others. To this end, in its development a methodological framework was implemented within the framework of the qualitative epistemic paradigm, which pointed to a documentary, analytical research, concluding in the existence of defenders and detractors of the settlement formulas, conversations and peace agreements raised, which leaves in evidence complex difficulties to remedy.
