Este proyecto de investigación consiguió determinar los factores materiales que conducen a la acción de repetición en la responsabilidad estatal por privación injusta de la libertad, en la legislación colombiana, al realizar un estudio cualitativo, con alcance descriptivo, de los títulos de imputación de Responsabilidad Patrimonial del Estado, el régimen de responsabilidad objetivo, el daño especial y el riesgo excepcional y del régimen de responsabilidad subjetivo, la falla en el servicio, el dolo y la conducta gravemente culposa, utilizando fuentes de información netamente secundarias, a partir de la búsqueda documental, las cuales se encontraban relacionadas con el tema objeto de investigación. Las cuales arrojaron como resultado, que los factores materiales que conducen a la acción de repetición en la responsabilidad estatal por privación injusta de la libertad, en la legislación colombiana, es el actuar doloso o gravemente culposo del agente del Estado (Policía Judicial, Fiscal o Juez) en el marco del proceso penal, al demostrar la intención o voluntad maliciosa del actuar del agente estatal en el proceso penal o la negligencia en el actuar del mismo. This research project was able to determine the material factors that lead to the action of repetition in state liability for unjust deprivation of liberty, in Colombian law, by carrying out a qualitative study, with descriptive scope, of the titles of imputation of State Patrimonial Responsibility, The objective liability regime, the special damage and the exception risk and the subjective liability regime, the failure in the service, the fraudulent fault and the grossly negligent fault, using clearly secondary sources of information, from the documentary search, which were related to the subject under investigation. As a result, the material factors that lead to the action of repetition in the state responsibility for unjust deprivation of liberty, in Colombian legislation, is the intentional or grossly culpable action of the state agent (judicial police, prosecutor or judge) in the framework of the criminal process, by demonstrating the intention or malicious will of the state agent to act in the criminal process or negligence in the act of the same.
