Acceso al Mecanismo de Protección al Trabajador Cesante en el Marco del Ordenamiento Jurídico Colombiano /

Abstract

El trabajo. El desempleo ha afectado en gran manera a la población colombiana, tanto así que en las recientes encuestas del Departamento Administrativo Nacional de Estadística – DANE - para abril del presente año, se encontró en 10,3%, esto ha generado que la comunidad se encuentre desprotegida para cumplir con sus compromisos económicos y sociales, por lo cual tiene como finalidad de protegerse por parte de la normatividad laboral en su artículo primero. No obstante, lo anterior, el estado siempre ha insistido en la necesidad de crear unos subsidios que se le entreguen a quienes luego de laborar se encuentren en el desempleo, para así solventar requerimientos básicos de la vida, por ello se creó la Ley 1636 de 2013, buscando de esa manera que se contara luego de la terminación de la relación laboral con unos valores básicos para las garantías de sus derechos, sin embargo; este auxilio es desconocido por las personas que tienen derecho a él. Por consiguiente, el Mecanismo de Protección al Cesante, es una garantía que tienen todas aquellas personas que han perdido el empleo, de gozar de un subsidio hasta por 6 meses, entre lo que incluye el pago de los aportes al Sistema de Seguridad Social. Luego entonces, el MPC, debe ser garantizado por el Estado colombiano una vez se cumplan con los requisitos contemplados en la LEY 1636 de 2013.

Therefore, the Mechanism for the Protection of the Unemployed, is a guarantee that all those who have lost their job have, to enjoy a subsidy for up to 6 months, including the payment of contributions to the Social Security System. Then, the MPC must be guaranteed by the Colombian State once the requirements contemplated in LAW 1636 of 2013 are met.
