EL DERECHO A LA VERDAD: UNA REFLEXIÓN SOBRE LAS DIMENSIONES LIMINALES EN LA TRANSICIÓN A LA PAZ

El derecho a la verdad ha sido reconocido desde la comunidad internacional, después de antecedentes jurisprudenciales respecto de compromisos del Estado, derivados del mismo derecho. La Corte Interamericana de Derechos Humanos construyó una interpretación del derecho
a la verdad como compromiso estatal, este derecho a la verdad ha sido
incluido en sistemas de transición a la paz como componente importante para la consecución de la justicia y la reparación. En ese sentido,
gran parte de lo que se conoce como derecho a la verdad, ha sido gracias a la justicia transicional como forma de restauración a víctimas de
crímenes de lesa humanidad y graves violaciones a Derechos Humanos.
La justicia transicional considera que la verdad es un deber del Estado
como garante de todos los derechos, también que el componente de
verdad en los sistemas de transición, debe cumplir medidas de satisfacción a las víctimas. En Colombia existe un proceso de transición, dicho
proceso ha permitido el desarrollo del sistema integral de verdad, justicia, reparación y garantías de no repetición, pactado en los acuerdos
de la Habana, firmados entre el gobierno de Juan Manuel Santos y las
fuerzas armadas revolucionarias de Colombia (FARC). En este proceso
de transición, la incertidumbre ha estado presente, en razón de la implementación de un sistema nuevo, el cual posee muchas ambiciones
respecto del posconflicto. The right to the truth has been recognized by the international
community, after jurisprudential precedents regarding State
commitments, derived from the same right. The Inter-American Court
of Human Rights constructed an interpretation of the right to the
truth as a state commitment. This right to the truth has been included
in systems of transition to peace, as an important component for the
attainment of justice and reparation. In that sense, a large part of
what is known as the right to the truth has been thanks to transitional
justice as a way of restoring victims of crimes against humanity and
serious violations of human rights. Transitional justice considers that
the truth is a duty of the state as guarantor of all rights, also that the
component of truth in transition systems, must comply with measures
of satisfaction to the victims. In Colombia, there is a transition process.
This process has allowed the development of an integral system of
truth, justice, reparation and guarantees of non-repetition, agreed upon
in the Habanna agreements, signed between the government of Juan
Manuel Santos and the Colombian armed revolutionary forces (FARC).
In this process of transition, uncertainty has been present, due to the
implementation of a new system, which has many ambitions, regarding
the post-conflict.
