DEBIDO PROCESO EN LA CIDH Y JUSTICIA INTERNACIONAL DE LOS DERECHOS HUMANOS COMO GARANTÍA DE REPARACIÓN

Abstract

El objetivo de nuestro trabajo consistió en establecer si la reparación de las víctimas y de la sociedad se puede alcanzar a falta de uno de los elementos de la Justicia Transicional como la verdad, la Justicia y la Garantía de No Repetición o si, por el contrario, es absolutamente necesario que se integren los pilares fundamentales de este ordenamiento jurídico especial para que se pueda lograr la verdadera reparación y por ende se alcance la reconciliación social. Teniendo en cuenta que se desarrolló una investigación teórica, se realizó un análisis documental de fuentes legales relativas al tema, de la doctrina nacional y extranjera y jurisprudencia de las altas cortes nacionales y de la Corte Interamericana de Derechos Humanos, entre otros documentos, como resultado del mismo se encontró una estrecha relación de entre la reparación como pilar esencial para alcanzar la paz y los demás ejes de la Justicia Transicional. En este sentido, se requiere que la justicia interna abarque de manera plena la restauración de los derechos de las víctimas y de la sociedad; y que además existen organismos jurisdiccionales internaciones encargados de velar por tal reparación.

The aim of our work was to establish whether the reparation of victims and society can be achieved in the absence of one of the elements of transitional justice such as truth, justice and the guarantee of non-repetition or, on the contrary, it is absolutely necessary that the fundamental pillars of this special legal order be integrated so that true reparation can be achieved and social reconciliation is achieved. Bearing in mind that it is a theoretical investigation, this research center has made a documentary analysis of legal sources related to the subject, national and foreign doctrine and jurisprudence of the national high courts and the Inter-American Court of Human Rights, among other documents, as a result, a close relationship was found between reparation as an essential pillar to achieve peace and the other axes of Transitional Justice. In this sense, internal justice is required to comprehensively encompass the restoration of the rights of victims and society; and that there are also international jurisdictional bodies responsible for ensuring such reparation.
