Esta investigación tuvo como objetivo analizar la responsabilidad objetiva del Estado por privación injusta de la libertad frente a la presunción de inocencia.; para ello se abordó de forma clara y concisa, lo concerniente a las nociones responsabilidad Estatal, el régimen de responsabilidad objetivo y daño especial como título de imputación aplicable en los casos en los que se declara patrimonialmente responsable al Estado cuando se priva de la libertad injustamente a un ciudadano con base al régimen de responsabilidad objetivo. Una vez culminado el estudio de la figura del daño especial, empezamos un breve recorrido por la figura de la responsabilidad del Estado por privación injusta de la libertad, haciendo hincapié en la normatividad de la figura, así como la evolución jurisprudencial que ha manejado el Consejo de Estado y la Corte Constitucional respecto al tema, se estudia de forma breve la figura de la presunción de inocencia. Se analizan las posturas que ha tenido el Consejo de Estado en la expedición de las sentencias por privación injusta de la libertad, de donde algunos casos ha condenado al Estado y en otros no, además se vislumbra que en la actualidad no existe una postura concreta del Consejo de Estado sobre este el tema, pues aquí el Juez Administrativo en la aplicabilidad de la justicia le concierne decidir expresamente la declaratoria o no de responsabilidad por privación injusta de la libertad, de acuerdo a lo acerbo probatorio surtido en el proceso. The objective of this research was to analyze the strict liability of the State for unjust deprivation of liberty versus the presumption of innocence; to do so, we addressed in a clear and concise manner, the notions of State liability, the regime of strict liability and special damage as a title of imputation applicable in cases in which the State is declared financially liable when a citizen is unjustly deprived of liberty based on the regime of strict liability. Once the study of the figure of the special damage is completed, we begin a brief tour of the figure of the liability of the State for unjust deprivation of liberty, emphasizing the normativity of the figure, as well as the jurisprudential evolution that the Council of State and the Constitutional Court have handled regarding the subject, the figure of the presumption of innocence is briefly studied. The positions of the Council of State in the issuance of sentences for unjust deprivation of liberty are analyzed, where in some cases the State has been condemned and in others it has not. It is also shown that at present there is no specific position of the Council of State on this issue, since here the Administrative Judge in the applicability of justice is concerned with expressly deciding whether or not to declare liability for unjust deprivation of liberty, according to the evidence gathered in the process.
